Terms of Service

1. Acceptance
These Terms of Service ("Terms") govern your access to and use of the cliniqboost website and services provided by cliniqboost, operated by Yassine Mohamed Rezigui. By using the site or services, you agree to these Terms.
2. Services
cliniqboost provides patient-communication automation software and related services for medical and aesthetic clinics, including appointment reminders, missed-call recovery, follow-ups, and related workflow tools. Specific deliverables, fees, and terms for paid engagements are set out in a separate written agreement between cliniqboost and the client.
3. Eligibility
You must be a business, or an authorized representative of a business, and able to form a binding contract to use the paid services.
4. Client responsibilities and consent
Clients are solely responsible for obtaining and maintaining all legally required consent from their patients before those patients are contacted through the services, and for complying with all applicable laws and carrier requirements (including TCPA and equivalent regulations). Clients represent and warrant that every recipient contacted through the services has provided valid opt-in consent.
5. Acceptable use
You agree not to use the services to send unlawful, deceptive, harassing, or unsolicited messages, or to violate any carrier policy or applicable law.
6. Fees
Fees for paid engagements are described in the applicable written agreement. Except as stated there or required by law, fees are non-refundable.
7. No medical advice
cliniqboost is a software and communications service, not a healthcare provider. The services do not provide medical advice, diagnosis, or treatment, and are not a substitute for professional medical judgment.
8. Intellectual property
cliniqboost retains all rights in its software, systems, content, and brand. No rights are granted except as expressly stated in a written agreement.
9. Disclaimers
The services and website are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, cliniqboost will not be liable for indirect, incidental, special, or consequential damages. Liability for paid engagements is limited as set out in the applicable written agreement.
11. Indemnification
You agree to indemnify and hold cliniqboost harmless from claims arising out of your use of the services or your breach of these Terms, including claims relating to messaging consent.
12. Termination
We may suspend or terminate access for violation of these Terms or applicable law. Terms for paid engagements are governed by the applicable written agreement.
13. Governing law
These Terms are governed by the laws of Algeria, without regard to conflict-of-laws rules.
14. Changes
We may update these Terms from time to time. The "Effective date" above reflects the latest version.
